Could my computer be confied if I am suspected to having an affair?

I live in NC. My husband and I have recently separated and he is trying to fight me for custody of our 2 daughters. He suspects that I have had an affair and suspects that I have left him for another man. He is saying that his attorney will be sending me a letter in the mail next week, saying that my computer will be confied and checked to see who I have been talking to online. To me this sounds like a huge invasion of privacy. Would a judge sign an order to have a computer checked out over a civil matter? I could understand if I was doing something illegal like kiddie but, just because i want out of a bad marriage and having my name slung through the mud??? Is this legal?
